What legal consequences for Iran's possible withdrawal from the Nuclear Non-Proliferation Treaty?

An Iranian university professor warned against his country’s exit from the Nuclear Non-Proliferation Treaty without observing the provisions of the treaty. He expected a large international response to the withdrawal, as happened with North Korea.

Referring to Iranian Foreign Minister Mohammad Javad Zarif’s threat to withdraw his country from the treaty, In an article in the Iranian newspaper “Arman Melli”, Mollaei stressed that the non-implementation of the terms of the nuclear agreement by some of the signatories to it, It does not constitute convincing evidence for the international community of the correctness of this withdrawal, And that there are strict laws applied towards exit from the treaty.

And Minister Zarif threatened last Monday that his country would withdraw from this treaty if the Iranian nuclear file was referred to the United Nations Security Council.

vital necessity:
The Iranian legal explained that exiting from the Treaty on the Non-Proliferation of Nuclear Weapons can only take place in the case of a vital national necessity that leads to persuading the international community. In particular, the International Atomic Energy Agency and the Security Council, at the legal level.

Article 10 of the treaty allows member states to leave if their supreme national interests are endangered by staying in it. A State wishing to withdraw must notify all signatory Member States, And also the Security Council, With this desire three months earlier, The notification shall contain a statement of major incidents that threaten Iran’s national interests.

The Iranian academic attributed the reason for the violent reaction to North Korea’s unilateral exit from the treaty to the international community’s belief that the withdrawing country did not want international organizations to monitor its nuclear activities. which could lead to international pessimism about Iran’s nuclear programme, And the possibilities of his exit from its peaceful framework.

The writer pointed out that the Security Council’s adoption of resolutions against Tehran regarding its nuclear program before the signing of the 2015 nuclear agreement, He explained that the reason for this is due to the belief of the International Atomic Energy Agency Board of Governors that the Iranian nuclear program was not transparent at the time.

And the Iranian legal added that exit from the treaty does not mean allowing violations of the specifications and laws related to atomic energy, Rather, the UN Security Council will then intervene and issue international resolutions against the country that withdrew from the treaty.

He concluded by saying that Tehran might want to pressure the European Troika by threatening to leave the said treaty, In order to prevent its nuclear file from being referred to the Security Council, But without a doubt, the result of withdrawing from it will not be what Tehran wants

The Iranian threat comes after France, Germany and Britain announced the activation of the dispute settlement mechanism included in the nuclear agreement due to what they considered “Iranian violations.” Referring to Tehran’s scaling back its commitments regarding uranium enrichment, and operating centrifuges in their nuclear reactors.
